How do I recognise domestic abuse?
Domestic abuse is identified by any incidents or patterns of behaviour that are controlling, coercive, threatening or violent towards an intimate partner or ex-partner.
Examples of domestic abuse:-
- Physical abuse (such as hitting, punching or biting)
- coercive control, emotional abuse (such as; assault, threats, punishments, intimidation, humiliation or any other abuse intended to frighten or punish the victim)
- sexual abuse (any sexual activity without consent)
- harassment (such as stalking, constant messaging/calling/emailing)
People who suffer domestic abuse usually experience more than just one type of abuse and over time the ‘abusers’ behaviour is repeated, escalates and becomes even more dangerous particularly if the abuser feels they are losing control over their partner.

How can I seek help as a domestic abuse victim?
Our family law specialists can advise you on the process you take in order to protect yourself. If you are being threatened by your partner we can help by applying to the Court for a Non Molestation Order which will prevent your abusive partner from causing any further harm to you and your children and/or an Occupation Order requiring your partner to leave your home and having left not to return to or come within a certain distance of it.
Domestic abuse and children
As a result of the Domestic Abuse Act 2021, children are now classed as victims of domestic abuse if they have seen or heard domestic abuse. It is proven that domestic abuse has a devastating impact upon children. 1 in 7 children under the age of 18 will witness domestic violence in their childhood. It is important to keep children protected from this and in doing so we can take the following steps to ensure children are protected if they are witnessing domestic abuse.
- Child Arrangements Order – this is a Court order that sets out who the child is to live with and what time they are to spend with the other parent.
- Prohibited Steps Order – this is a Court order to prevent a parent removing your child from your care, school and the jurisdiction.
- Specific Issue Order – this is a Court order dealing with specific issues in a child’s life for instance with regard to medical treatment, education or faith.
